Terms and Conditions – Guardian Radar

1. Identification of the parties and acceptance
This document sets out the Terms and Conditions for the provision of the "Guardian Radar" service (hereinafter, the "Agreement").
On one part, QUALITEASY INTERNET SOLUTIONS SL (hereinafter, "THE PROVIDER"), with tax ID B61626875 and registered address at Pit Roig 26, Block 7, 3rd Floor B, 08800 Vilanova i la Geltrú, Barcelona (Spain).
On the other part, the individual or legal entity that completes the registration process through the website (hereinafter, "THE CLIENT").
Submitting the registration form, sending data through the website's enabled channels and/or ticking the acceptance checkbox implies that THE CLIENT has read, understood and fully accepted this Agreement, and is bound by it without the need for a handwritten signature.
2. Subject matter
This Agreement covers the provision of the Guardian Radar service, consisting of an external digital risk monitoring system designed to detect potential information exposures, compromised credentials or domain impersonation associated with THE CLIENT.
3. General service description
Guardian Radar is a preventive digital surveillance service that analyses information from public breach databases, compromised credential repositories on the Dark Web, domain registries and open Internet sources.
Preventive alerts: The system detects matches between these sources and the identifiers provided by THE CLIENT. When a potential risk is detected, the system generates an informational alert.
Support and "Panic Button": The service includes a direct communication channel (via WhatsApp or similar) for quick queries about suspicious emails or links (phishing). This support consists of a quick visual and preventive analysis and does not replace a forensic analysis, code audit or technical response to complex incidents.
4. Service plans
Guardian Radar Freelance: Includes monitoring of 1 email address and 1 domain.
Guardian Radar SME: Includes monitoring of up to 10 email addresses and 3 corporate domains.
Additional Services (On demand): THE CLIENT may request one-off services, such as the "Technical Domain Report", billed independently from the subscription.
5. Operation and Service Levels (SLA)
The service operates through automated and continuous external scanning. THE PROVIDER does not access THE CLIENT's internal systems or email content, does not install software on their devices, and does not carry out internal audits. Due to the nature of the external sources monitored, immediate detection cannot be guaranteed.
6. Alerts and notifications
Risk notifications will be sent to THE CLIENT via email, WhatsApp or the service dashboard. Alerts are exclusively informational and preventive in nature and do not constitute confirmation of an intrusion or active attack.
7. Service exclusions
The subscription does not include: cybersecurity incident response, attack containment, malware removal, forensic analysis, recovery of compromised accounts or direct management of IT incidents. These services may be quoted and contracted separately by independent agreement.
8. Obligations and Acceptable Use Policy
THE CLIENT undertakes to provide accurate, truthful and up-to-date information and warrants that they have the legitimate and legal right to provide such data for monitoring purposes. Where THE CLIENT provides email addresses belonging to employees or other individuals, THE CLIENT declares that they have fulfilled all applicable information and/or consent obligations under the GDPR and applicable employment law, and is solely responsible for such compliance. THE CLIENT undertakes to act diligently upon receiving alerts. The effective security of THE CLIENT's systems remains their exclusive responsibility.
9. Duration, renewal and satisfaction guarantee
This Agreement requires no minimum commitment period and will last for the billing cycle selected (monthly or annual). Upon expiry, the service will automatically renew for equal periods unless THE CLIENT notifies their intention not to renew before the next billing date.
Satisfaction guarantee (15 days): THE CLIENT has fifteen (15) calendar days from the initial activation to request cancellation and a full refund of the amount paid.
10. Price, Promotions and Billing
THE CLIENT will pay the price corresponding to the selected plan and billing cycle. Amounts will be those publicly displayed on the website at the time of contracting.
If THE CLIENT takes advantage of a promotion, it will only be valid during the specified period. Once the promotional period ends, renewals will be billed at the standard rate in force at that time.
Failure to pay will result in automatic suspension of the service.
11. Limitation and exclusion of liability
Guardian Radar is a digital risk intelligence service, not antivirus software or a firewall. THE PROVIDER does not guarantee detection of all threats or prevention of unauthorised access. In no event shall THE PROVIDER be liable for economic losses, loss of profits, business interruption, reputational damage, data loss or regulatory penalties. THE PROVIDER's maximum liability for any claim arising from this Agreement shall be limited to the total amount paid by THE CLIENT during the last twelve (12) months of service.
12. Intellectual property
The platforms, software, reports and technological tools used are the exclusive property of THE PROVIDER or its licensors. This Agreement does not grant THE CLIENT any ownership rights, commercial licence for third parties or modification rights over such technologies.
13. Confidentiality and Data Protection
Both parties shall maintain strict confidentiality over information exchanged. THE PROVIDER will process personal data provided by THE CLIENT in accordance with the GDPR and applicable Spanish data protection law, solely for the purpose of providing the contracted service, managing billing and support. Data will be retained for the duration of the Agreement and, once terminated, for the legally required periods. THE PROVIDER may engage data processors (third-party technology providers) who will always act under appropriate contractual instructions and guarantees. THE CLIENT may exercise their rights of access, rectification, erasure, objection and restriction of processing by writing to qualiteasy@qualiteasy.com.
14. Governing law and jurisdiction
This Agreement is governed by Spanish law. The parties submit to the jurisdiction of the Courts of the city of Barcelona, unless the law mandatorily provides otherwise (as in the case of consumers).
